Terms of Service

These Terms of Service (“Terms”) govern your access to and use of SmartCSR, a product of Belmont Digital Marketing (“SmartCSR,” “we,” “us”), including the smartcsr.pro website and the SmartCSR service (together, the “Service”). By using the Service, you agree to these Terms.

The Service

SmartCSR provides client intake and service-management tools for insurance agencies. We may add, change, or discontinue features over time.

Eligibility & Accounts

You must be at least 18 and able to form a binding contract. You are responsible for the accuracy of the information you provide and for keeping your account credentials secure.

Subscriptions, Billing & Refunds

• Plans are billed on a month-to-month basis, in advance. Each product is $97/month; any two products are $149/month and all three are $199/month.
• You can cancel at any time; cancellation takes effect at the end of the current billing period.
• We offer a 30-day money-back guarantee for new subscriptions. There are no setup fees.
• We may change pricing with reasonable advance notice.

Acceptable Use

You agree not to misuse the Service, including by using it unlawfully, attempting to disrupt or reverse-engineer it, or violating applicable laws and regulations (including insurance and privacy regulations). You are responsible for obtaining any consents needed to collect and process your clients’ information through the Service.

Your Data & Content

You retain ownership of the agency and client data you put into the Service. You grant us a limited license to host and process that data solely to provide and improve the Service. You represent that you have the right to collect and share that data.

Intellectual Property

The Service, including its software, design, and brand, is owned by us and protected by intellectual-property laws. These Terms do not grant you any ownership of the Service.

Third-Party Services

The Service can connect to third-party tools (for example, your AMS, CRM, or automation platforms via webhooks). Your use of those tools is governed by their own terms, and we are not responsible for them.

Disclaimers

The Service is provided “as is” without warranties of any kind. SmartCSR is a software tool and does not provide legal, insurance, or compliance advice.

Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, or consequential damages. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim.

Indemnification

You agree to indemnify and hold us harmless from claims arising out of your use of the Service or your data, to the extent permitted by law.

Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if necessary to protect the Service.

Governing Law

These Terms are governed by the laws of the State of Utah and applicable United States federal law, without regard to conflict-of-law principles. Any disputes will be brought in the state or federal courts located in Utah.

Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
